Submitting the application
The application must be made using a form available from the relevant institutions or accessible online. Page 1 of the form must be completed by a representative of the institution hosting the applicant. The form must then be signed by the applicant. If the applicant requires representation to carry out these actions, the application must be signed by their legal representative or legal administrator, i.e. their guardian, curator, official representative or the person exercising legal protection.
Reimbursement of the supplement
The Fund may claim reimbursement of the supplement paid:
- to the beneficiary who has regained their financial standing;
- to the beneficiary's donee or legatee, within certain limits. Please note: no reimbursement may be claimed from the donee if the donation was made more than 10 years prior to the request.
Regarding inheritance:
- The Fund cannot claim restitution on a minimum portion of the inheritance (€ 287,962.85 NI 968.04 for the spouse/partner or descendants, €1,742.47 index 968.04 for others.
- If the spouse/partner continues to live in the beneficiary's home, the Fund cannot claim restitution on this home and its furnishings, but may register a mortgage on it to protect its rights.
Appeals
A decision by the National Solidarity Fund (FNS) may be appealed within 40 days of notification.
This appeal must be made directly to the FNS Board of Directors.
The decision of the FNS Board of Directors may be appealed within 40 days of notification to the Social Security Arbitration Board.
